The illegality usually stems from the house collecting some sort of revenue from running the game. That could mean running a game with a house edge, taking a rake from a poker game, or something as benign as charging a cover to recoup food & drink expenses. The reason is ultimately because a home game is unregulated. The state can't ensure the game is being run properly. Also, at what point does the jurisdiction decide a game is no longer a home game and has become an actual casino/card room? Dorinda Metzer: Only certain forms of gambling are illegal. You cannot host any type of game where the players are playing against 'the house.' That means you cannot throw a roulette party or blackjack where the players are playing against the house.You are allowed to have an event where the players are playing each other like a poker game and there is no house advantage.
